Can a company force its employees to have the Covid-19 vaccine?

With the Covid-19 vaccine being rolled out across the º£½ÇÊÓÆµ, an employment lawyer explains the legalities around a mandated vaccination

The Covid vaccine has arrived in the º£½ÇÊÓÆµ and with it a long list of questions.

One of the key ones being around the topic of mandated vaccinations, particularly at the insistence of employers.

David Sheppard, an employment lawyer from Capital Law, outlines the legal perspective.

The law

Currently there are no statutory provisions which would allow any º£½ÇÊÓÆµ government to force individuals to become vaccinated.

The Public Health (Control of Disease) Act 1984 actually provides for the opposite. Whilst it legislates to prevent, control and mitigate the spread of contamination or infections, it specifically states that members of the public should not be compelled to undergo any mandatory medical treatment, including vaccinations.

If any government of the º£½ÇÊÓÆµ were to legislate the right to insist on compulsory vaccination, it could feasibly give rise to numerous objections on the grounds of individual liberty and human rights.

Article 8 of the European Convention on Human Rights protects people from being interfered with physically or psychologically, which includes mandatory vaccinations.

Any legislation compelling vaccination would therefore likely be deemed incompatible with Article 8.
